Terms of Service

These terms are a binding agreement between you and idTAG.app. They apply whether you hold an account, view a card, or submit your details through a card. Please read them before using the service.

Parties and acceptance

idTAG.app,” “we,” and “us” mean idTAG.app, operated from Wesley Chapel, Florida. “You” means the person using the service, whether you hold an account, view a card, or submit your details through a card.

By creating an account or otherwise using the service, you accept these terms and the privacy policy, which forms part of this agreement. If you do not accept them, do not use the service.

If you accept these terms on behalf of an organization, you represent that you have the authority to bind it, and “you” means both you and that organization.

Eligibility and accounts

  • You must be 18 or older to hold an account.
  • You must register with an email address you control. It is how we reach you and how you regain access to your account.
  • You are responsible for activity that occurs under your account. Keep your email account secure, and notify us at email@idtag.app if you believe someone else has gained access to yours.
  • Accounts are for a single person. One account may hold multiple cards.

The service

idTAG.apphosts contact pages. You enter your details; we publish them at a short address, allow visitors to download them as a standard vCard file, generate a QR code for the page, and, if you enable it, collect responses from visitors through a form on the card. For your own cards we also generate companion artifacts on request — an Apple or Google Wallet pass and email signatures built from the card’s details.

We do not verify the identity of card owners or the accuracy of anything on a card. A card is a statement made by its owner. It is not a credential issued or endorsed by us. Every public card carries a link for reporting it.

Your content

You retain all rights you hold in the content you publish — text, photographs, logos, and files. We claim no ownership of it.

You grant us a worldwide, non-exclusive, royalty-free license to store, reproduce, display, and transmit that content, and to create the derivative works the service requires: resized and re-encoded images, the vCard file visitors download, the QR code, and the link preview image. The license exists solely to operate the service, is not transferable except to a successor in a merger or acquisition, and terminates when you delete the content, subject to the time it takes backups to expire and to copies already saved to visitors’ devices, which we cannot reach.

You represent that you hold the rights necessary to publish everything on your card, including any logo, trademark, photograph, or file owned by someone else.

Acceptable use

You may not use idTAG.app to:

  • Impersonate a person, company, or public body, or claim an affiliation, endorsement, credential, or employment you do not hold.
  • Publish another living person’s contact details, photograph, or private information without their permission.
  • Conduct phishing or fraud, or operate any scheme that depends on misleading the person reading the card about who they are dealing with.
  • Host or link to malware, illegal material, sexually explicit material, or content that harasses a person or incites violence.
  • Violate any law that applies to you, or assist anyone else in doing so.
  • Scrape, crawl, or bulk-collect cards or the contact details on them; resell or white-label the service; or circumvent rate limits, authentication, or other technical controls.
  • Disrupt the service, including load testing, vulnerability scanning against production systems, or any activity that degrades the service for other users. Report security issues to email@idtag.app.

Card addresses and handles

Every card is issued a permanent five-character address. You may also claim a custom handle.

Handles are granted on a first-come, first-served basis. Claiming one grants the right to use it while your account remains in good standing; it does not transfer ownership of the handle to you.

We may reclaim or reassign a handle that is being warehoused for resale, used to impersonate a person or organization, or that infringes a trademark. Where circumstances allow, we will notify you before doing so.

Contacts collected through your card

When a visitor submits the form on your card, they are providing their details to you. We store those submissions on your behalf and make them available in your dashboard. Under applicable privacy law you are the controller of those records and we act as your processor: we process them on your instructions and do not use them for our own purposes.

As the controller, you are responsible for:

  • Using the details for the purpose for which they were provided, and not adding them to marketing lists the person did not agree to join.
  • Establishing a lawful basis and obtaining any consent required before contacting them. Compliance with CAN-SPAM, the TCPA, the GDPR, and comparable laws is your obligation, not ours.
  • Not selling those records or otherwise disclosing them for consideration.
  • Deleting a person’s details on request. If the request reaches us instead, we will remove the record and notify you.
  • Limiting the questions on your form to what you need. Do not request government identifiers, health information, financial account details, or passwords.

Claims arising from your handling of contacts collected through your card are covered by the indemnity below.

Third-party links

Links on a card resolve to sites we do not operate. We do not review, endorse, or accept responsibility for their content, and we are not a party to any dealings between you and them.

Reports and enforcement

Every public card carries a “Report this card” link. Reports are reviewed by a person.

Where a card violates these terms, we may disable it, remove content from it, release its handle, or suspend or close the account behind it. In cases of impersonation, fraud, or a credible risk to someone’s safety, we will act immediately and without prior notice. Otherwise we will notify the account holder of the action and the reason for it.

To contest an enforcement action, write to email@idtag.app and we will review the decision.

Copyright and trademark complaints

If material on a card infringes your copyright, send a notice to email@idtag.app containing:

  • Your physical or electronic signature.
  • Identification of the copyrighted work.
  • The address of the card and identification of the material claimed to be infringing.
  • Your name, address, telephone number, and email address.
  • A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorized to act on the owner’s behalf.

We will remove or disable access to the material and notify the card owner, who may submit a counter-notice containing the equivalent information. We close the accounts of repeat infringers.

Trademark complaints, including complaints about a handle or a logo, go to the same address and should identify the mark, its registration number if registered, and the card at issue.

Fees and subscriptions

The core service is free. The Pro plan costs $25 per year, billed as an automatically renewing subscription: on each anniversary of your purchase, the payment method you provided is charged for the next year until you cancel. Prices are stated in US dollars and exclude any taxes we are required to collect, which are added at checkout where they apply.

Payment is processed by Stripe, our payment processor. We never see or store your full card number. By subscribing, you authorize us and Stripe to charge your payment method on each renewal.

  • Cancelling. You may cancel at any time from the billing page in your dashboard. Cancellation takes effect at the end of the period already paid for: you keep Pro until that date, and the plan then reverts to Free. Your cards stay up either way.
  • Refunds. Except where the law of your jurisdiction requires otherwise, payments are non-refundable and we do not give credits or refunds for partial subscription periods. If you believe you were charged in error, write to email@idtag.app within 30 days of the charge and we will review it.
  • Failed payments.If a renewal charge fails, Stripe retries it and emails you to update your payment method. If it cannot be collected, the subscription is cancelled and the plan reverts to Free. Cards over the Free plan’s limits stay published, but you cannot add more until you re-subscribe or remove some.
  • Price changes. We may change subscription prices. A change applies to you no earlier than your next renewal, and we will notify you by email at least 30 days before a renewal at a higher price. If you do not accept the new price, cancel before the renewal.
  • Plan changes. Features may move between free and paid tiers over time, with reasonable notice before a change to features you actively use.

Availability and changes to the service

We do not guarantee any level of availability. The service may be unavailable for maintenance or for reasons outside our control. We may add, change, or remove features. If we discontinue the service, we will give as much notice as is reasonably practicable and provide a means of exporting your cards and contacts.

Disclaimer of warranties

The service is provided “as is” and “as available,” without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure against every attack, or that content on any card is accurate. Some jurisdictions do not permit certain disclaimers; where that is the case, this section applies to the fullest extent the law allows.

Termination

You may delete a card at any time from your dashboard. To close your account, write to email@idtag.app; we will close it and confirm when it is done. In either case the affected cards stop resolving, and the data is deleted on the schedule set out in the privacy policy. Once a card is deleted, every link and QR code issued for it stops working. Closing your account cancels any active subscription at the end of the period already paid for; it does not by itself entitle you to a refund.

We may suspend or close an account that violates these terms, that exposes us or another user to legal liability, or that has been inactive for an extended period. We will give notice except where the violation makes notice unreasonable.

The following survive termination: the license wind-down described in “Your content,” the indemnity, the disclaimer of warranties, the limitation of liability, and the governing law and disputes section.

Indemnification

You agree to defend, indemnify, and hold harmless idTAG.appand its personnel from any claim, damage, loss, or reasonable legal expense arising out of the content you publish, your use of contacts collected through your card, your breach of these terms, or your violation of any third party’s rights. We will notify you promptly of any such claim and allow you to control the defense, provided that any settlement affecting us requires our consent.

Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost business, lost contacts, or lost data, even if advised of the possibility.

Our total liability for all claims arising out of or relating to the service is limited to the greater of the amount you paid us in the twelve months preceding the claim or one hundred US dollars. This limitation is an essential element of the agreement between us.

Governing law and disputes

Before filing a claim, send a description of the dispute to email@idtag.app. Both parties will attempt in good faith to resolve it within 30 days of that notice.

This agreement is governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute not resolved under the preceding paragraph will be brought exclusively in the state or federal courts located in Pasco County, Florida, and both parties consent to the personal jurisdiction of those courts.

Both parties waive the right to a trial by jury. Both parties agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class or representative proceeding. Any claim must be filed within one year after it arises or it is permanently barred, except where applicable law does not permit that limitation.

Changes to these terms

We will revise these terms as the service changes. For material changes, we will notify account holders by email and update the date above before the change takes effect. Continued use of the service after the effective date constitutes acceptance of the revised terms. If you do not accept them, delete your account.

General

  • These terms and the privacy policy are the entire agreement between the parties regarding the service, and supersede any prior understanding.
  • If a provision is held unenforceable, it will be narrowed to the minimum extent necessary and the remainder will stay in effect.
  • A failure to enforce a provision is not a waiver of it.
  • You may not assign this agreement without our written consent. We may assign it to an affiliate or to a successor in a merger or acquisition.
  • Neither party is liable for a failure to perform caused by circumstances beyond its reasonable control.
  • Legal notices to us go to email@idtag.app. Notices to you go to the email address on your account.
  • Nothing in these terms creates a partnership, agency, or employment relationship.
